Intent-to-use applicants must file a Statement of Use ($100 per class) or extensions to the Statement of Use before the trademark can register. Up to 5 extensions are allowed, each for 6 months. The first extension is $125 per class; subsequent extensions are $225 per class. These fees are per 37 CFR 2.76 and 2.89.

Trademark registration process

  • Filing: submit the application via TEAS (Trademark Electronic Application System) with the filing fee.
  • Examination: a USPTO examining attorney reviews the mark for conflicts and compliance (typically 6 to 8 months after filing).
  • Publication: approved marks are published in the Official Gazette for a 30-day opposition period.
  • Registration or Notice of Allowance: use-based applications receive a registration; intent-to-use applications receive a Notice of Allowance, after which a Statement of Use must be filed.
  • Maintenance: Section 8 declarations (years 5 to 6 and every 10 years) and Section 9 renewals (every 10 years) are required to keep the registration active.

What does it cost to register a trademark with the USPTO?

What is TEAS Plus vs TEAS Standard?

TEAS Plus requires using only the USPTO's Acceptable Identification of Goods and Services Manual (ID Manual) descriptions and meeting additional requirements at the time of filing. It costs less per class ($250 vs $350). TEAS Standard allows custom descriptions of goods and services and has fewer upfront requirements.

What is an international class?

Trademarks are registered in one or more of 45 international classes under the Nice Classification system. Classes 1 through 34 cover goods; classes 35 through 45 cover services. Each class requires a separate filing fee. A brand selling clothing (class 25) and operating a retail store (class 35) would need two classes.

How long does trademark registration take?

The USPTO typically takes 8 to 12 months to examine an application and issue a registration (longer if there are office actions or oppositions). The total process from filing to registration often takes 12 to 18 months or more. Trademark rights in the US arise from actual use in commerce, so common law rights exist even before registration.

What maintenance fees are required after registration?

Registered trademarks require periodic maintenance filings to remain active. Between years 5 and 6 after registration, a Declaration of Use (Section 8) must be filed ($225 per class for TEAS). Between years 9 and 10, a combined Section 8 and Section 9 (renewal) filing is required ($325 per class). Thereafter, Section 8 and 9 filings are due every 10 years.
