Arbitration Cost Calculator
Arbitration costs include filing fees paid to the arbitration institution (such as AAA or JAMS), arbitrator compensation, and case management fees. This calculator estimates costs based on the claim amount, chosen institution, number of arbitrators, and estimated hearing days. Fees are sourced from AAA and JAMS published schedules effective 2024. Always verify current fees directly with the arbitration institution before filing, as fee schedules are updated periodically.
Fees based on AAA Commercial Arbitration Rules and JAMS Comprehensive Arbitration Rules effective 2024. Verify at adr.org or jamsadr.com.
Arbitration cost formula
Filing Fee = based on amount in controversy (from institution schedule)
Arbitrator Fees = Daily Rate * Hearing Days * Number of Arbitrators
Case Management Fee = Arbitrator Fees * Management Fee Rate
Total = Filing Fee + Arbitrator Fees + Case Management Fee
AAA Commercial filing fees by claim amount (2024): under $10,000: $775; $10,000 to $75,000: $975; $75,000 to $150,000: $1,850; $150,000 to $300,000: $2,800; $300,000 to $500,000: $4,350; $500,000 to $1,000,000: $6,200; over $1,000,000: $10,300. AAA case management fees are approximately 15% of arbitrator compensation. JAMS charges a 12% case management fee.
Arbitration vs litigation cost comparison
- Arbitration eliminates court filing fees ($405 in federal court) but substitutes institution filing fees (which can be higher for large claims).
- Arbitration adds arbitrator fees (typically $300 to $600/hour), a cost that does not exist in court litigation where judges are paid by the government.
- Arbitration typically reduces discovery costs, as discovery is limited compared to litigation.
- Arbitration often resolves faster than litigation, reducing attorney fees.
- A three-arbitrator panel is significantly more expensive than a single arbitrator but may be preferred for complex or high-value disputes.
Arbitration cost calculator: frequently asked questions
What is arbitration?
Arbitration is a private dispute resolution process in which the parties agree to submit their dispute to one or more neutral arbitrators whose decision (called an award) is typically binding. Arbitration is an alternative to litigation and is common in commercial contracts, employment agreements, consumer disputes, and international transactions.
How much does AAA arbitration cost?
The American Arbitration Association (AAA) charges filing fees based on the amount in controversy. Under the Commercial Arbitration Rules, filing fees for claims of $10,000 to $75,000 are $975; for claims of $75,000 to $150,000, the fee is $1,850; for $150,000 to $300,000, it is $2,800. Arbitrator compensation is separate and is charged at the arbitrator's hourly or daily rate. AAA also charges case management fees.
How much does JAMS arbitration cost?
JAMS (Judicial Arbitration and Mediation Services) filing fees for non-employment arbitrations start at $1,750 for claims under $250,000. JAMS arbitrator rates are typically $400 to $600 per hour (sometimes higher for very experienced arbitrators). JAMS charges a 12% case management fee on all arbitrator fees.
Who pays for arbitration?
In commercial arbitration, costs are typically split between the parties or allocated by the arbitrator at the end of the proceeding. Some arbitration agreements specify that the party initiating the arbitration pays the filing fee. Consumer and employment arbitration agreements often must comply with AAA or JAMS consumer or employment supplementary rules, which may shift more costs to the business.
Is arbitration cheaper than litigation?
For straightforward disputes, arbitration can be faster and cheaper than court litigation, primarily due to reduced discovery and a simpler process. However, for complex multi-party disputes or those requiring extensive discovery, arbitration costs (particularly arbitrator fees) can rival or exceed litigation costs. The arbitrator's hourly or daily fees are a significant cost driver that does not exist in court litigation.
